2.       Personal data and principles for processing of personal data – GDPR

2.1.  “Personal data” means any information relating to an identified or identifiable natural person (hereinafter: data subject), an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2.2.  “Processing” of personal data means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

3.        Processing of personal data

3.1.  We only process your personal data in the following cases:

-          processing is necessary for compliance with a legal obligation to which the controller is subject;

-          processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

4.1.  We only store your personal data for as long as we need it for the purposes for which we store it, to meet your needs, or for compliance with our legal obligations.

5.1.  We are committed to safe storage of your personal data using all appropriate security measures. We contractually require trusted third parties who handle your personal data to do the same.

-          the processing is unlawful and you oppose the erasure of personal data concerning you and request the restriction of its use instead,

-          we no longer need the personal data concerning you, but we need it for the establishment, exercise or defence of legal claims,

-          you object to processing pending the verification whether our legitimate grounds override your legitimate grounds.

6.5.  Right to portability: At your request and if technically feasible, we will transmit your personal data to another controller if the processing is based on your consent or is relevant for the performance of the contract, and if the processing is carried out by automated means.

6.6.  The right to object: If the processing is based on your consent or is relevant for the performance of the contract and if the processing is carried out by automated means, you can at any time object to the processing of personal data related to these reasons on grounds relating to your particular situation. Where personal data concerning you is processed for direct marketing purposes, you shall have the right to object at any time to processing of personal data for such marketing, which includes profiling. In addition, on grounds relating to your particular situation you shall have the right to object to the processing of personal data, when personal data are processed for scientific or historical research purposes or statistical purposes, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

6.7.  Automated individual decision-making, including profiling: You shall have the right to request not to be subject to a decision based solely on automated processing of personal data concerning you, which produces legal effects concerning you or significantly affects you.

6.8.  Right to lodge a complaint: In the event of an alleged infringement of applicable privacy laws, you may lodge a complaint with the data protection supervisory authority in the country where you reside or where the alleged infringement occurred.

6.9.  Right to erasure: You can request us to erase the personal data concerning you where one of the following grounds applies:

-          the personal data are no longer necessary in relation to the purpose for which they were collected or otherwise processed,

-          you withdraw consent on which the processing is based, and there is no other legal ground for the processing,

-          the processing is based on your consent and you object to the processing, and there is no other legal ground for the processing,

-          your personal data have been unlawfully processed,

-          this is necessary for compliance with the legal obligations.
